9. Arbitration and Dispute Resolution

By accessing or using the Site, you agree to settle any dispute that arises according to the following dispute resolution process; and if necessary, to settle any dispute by a third party Arbitration service, to waive your right to file any class lawsuit or settlement by a court.

Dispute Resolution Process

If any dispute arises between you and the Company, both parties shall first attempt to resolve the issue amicably through Negotiation. Parties agree to pursue a resolution that is mutually agreed-upon as a Good Faith Effort.

As A Good Faith Effort, each party agrees to:

  • Promptly notify each other in writing of any dispute.

  • Provide relevant details and expectations.

  • Determine and establish a mutually agreed-upon period of time that is reasonable for the negotiation process.

Arbitration

If Good Faith Efforts do not lead to a resolution within the mutually agreed-upon time frame, either party may initiate the mediation of an Arbitration service to facilitate discussions.

  • GOVERNING LAW

    The laws of the State of Indiana shall govern the agreement and shall be in accordance with the rules of the American Arbitration Association (AAA) or another mutually agreed-upon arbitration service.

  • VENUE

    The arbitration shall take place in a mutually agreed upon location.

  • RESPONSIBILITIES

    Each party shall bear their own costs associated with the arbitration.


Exceptions

This dispute resolution clause does not apply to injunctive relief or actions seeking equitable remedies.

Either party may seek injunctive relief in a court of competent jurisdiction to prevent irreparable harm pending resolution through arbitration.
